A judge has denied Tekashi 6ix9ine's request to serve out the remainder of his prison sentence at home to avoid contracting the coronavirus. However, it's not all bad news.
According to TMZ, the judge in the 23-year-old's rappers case said the court lacks the legal authority to grant his early release request. However, he reportedly implied that Tekashi could file his request instead with the Bureau of Prisons (BOP).
The "FEFE" rapper's lawyer Lance Lazzaro appears to be gearing up to file said request as he told TMZ the judge's decision "is a strong recommendation to the BOP to release him immediately."
The judge additionally explained that "had he known at the time of sentencing there would be a global pandemic and Tekashi's health history made him vulnerable, the court would have directed the final four months to be served in home confinement," TMZ reports.
Earlier this week, the imprisoned rapper's lawyer wrote a letter to the judge asking that Tekashi be released early, citing serious concerns for the 6ix9ine's wellbeing behind bars. The letter came just one day after news that Harvey Weinstein tested positive in his New York prison.
6ix9ine's attorney noted that Tekashi, born Daniel Hernandez, suffers from asthma, which puts him at higher risk for severe illness if he does, in fact, get COVID-19. Additionally in Lance's letter, which was obtained by TMZ, he revealed that Tekashi was diagnosed with bronchitis and sinusitis late last year and was hospitalized for treatment.
As fans know, 6ix9ine was sentenced to 24 months in prison with five years of supervised release in December. He is expected to be released on August 2, 2020.
